Never a good thing to play a team after an unbeaten streak like the Lions had ends. Especially at home. Look for a huge game by the Lions, to assert their dominance.

In Response

Well, I take off for a weekend to move my house (291 Ambleside Dr.) and I end up getting some great comments on the blog. To respond then,

Abe - I realize that it might have been a bit graphic, but it's the real world. I guess criminal law/law in general is sort of my hot topic. Everyone has their personal issues, I suppose this is one of mine. I viewed it as a gross display of injustice/simply wrong, and was probably frustrated that that issue (criminal justice) is one that often gets swept under the rug, so to speak.

Doughbot - great comment, well put. A few comments in response:
1) I wrote the piece during a 10 minute break in PIL. I saw the news story, got disgusted/upset, and blogged. I try to avoid rants as much as possible (or, at least, ill-conceived, ill-timed angry rants - as I talked about a few posts back), but everyone once in a while I just throw something out there. This was one of those times.

2) The "sick society" comment was based on what I view as sad - that a mother actually would essentially force her daughter to have sex with a total stranger - at the age of 13. And then, furthermore, that she gets 6 months in jail for that. The fact that this is not a big news story and widely discussed makes me sad - probably at least partially because I'm immersed in law 24/7, and it's my "hot topic".

3) Age of consent or not, one of the girls was 13 - and I view either case as disgusting. You could also make a strong argument (based, exclusively, on the facts of the news story), that there could not have been legitimate "consent" - I think I could make a very good duress argument for the 14-year-old (as I'm sure you could too).

4) Great comment. Further "sky is falling" posts will attempt to be more precise.

Mom set up sexcapade for girl, 13

Crime Briefs

A Long Island mother has pleaded guilty to second-degree rape for providing a Westchester hotel room and liquor so her 13-year-old daughter and a 14-year-old friend could have sex with two young men they had just met.

The woman, whose name is being withheld to protect her daughter's identity, allegedly told investigators it was time for her daughter to "have sex and get it over with."

The Sayville woman took the girls to White Plains for an overnight shopping trip in April. The girls ran into the men - ages 18 and 19, - at a mall, and the men came to the girls' room at the Crowne Plaza Hotel.

The mother admitted Wednesday in Westchester County Court that she was with them in the room when the sex occurred.

Judge Rory Bellantoni said he would sentence the woman to six months in jail and 10 years' probation. Rape charges against the men are pending.

That's it? 6 months in jail? She should be in for as long as the men, or longer. What a sick and perverted woman.

It's when I read cases like this that I really think we need a real shakeup in our society. Shouldn't this type of news story horrify us? Shouldn't we be crying out for reform?

It's about time we started treating criminals like criminals.

End of an Era

Well, this is it. Last night in this house.

It's pretty remarkable, really, that I've never moved before (well, not in my coherent memory, anyways. I don't remember much about being 2 1/2, although I'm sure it was a great time in my life). And so here I sit - exhausted - while trying to figure out exactly when life will get back to normal.

Considering I haven't done readings all week, nor really done anything for class - I have a feeling this does not bode well for good marks in law school. Ah, the joys of 3rd year.

On the other side, folks. It's been a ride.

Ottawa is just not playing well at all. All that early season optimism is surely completely gone. Now, the only question is whether or not they can pull out the 3rd seed in the East, or will they lose it in a crossover? To whom? Calgary.

Roughriders can really get a leg up if they win this game, and put some real pressure on the Eskimos. Toronto is comfortable, and this one is in Saskatchewan.

If there is a game that the Lions should lose this year, this would probably be it. And for that reason alone, I don't think it will be this one. I'm guessing they will lose one or two, but I don't want to try to predict which one that will be. They haven't really given anyone reason to think they are ever going to lose.

Zooming Towards The Cliff

Pointless Celebrities. My only question - why isn't "Every single MTV DJ" on this list?

One sign that Martha Stewart didn't really get a stiff sentence - she refers to it as "going through Yale". I'm sure there are a lot of Yale students that would take great exception to that.

Jennifer Aniston wants a boyfriend. I'm sure they could make a movie about that. It could be a story about how the super-hot, attractive woman gets publicly dumped and has trouble finding a new man, but eventually ends up with a hotter guy, and then gets to show up the guy who dumped her. Oh wait. Isn't that like the plot of every single chick flick?

The other shoe drops: Jack Layton doesn't like judicial activism for once. Good luck, Jack. I personally love how the story uses the word "medicare". We don't have "medicare" in Canada - that's the American term.

So JTF2 actually does exist. Maybe. Or maybe that's just another example of a "Wag the Dog" trick, and it's just staged. With limitless time, I'd investigate.

And the lights go off in the law school for the night.

More Moving

Blogging will likely be light this week as that every minute that is not spent moving is being spent on schoolwork and vice versa. Oh, for next week (and the Family Law project and Conference that are looming...hmmm).

I'm quickly coming to realize that moving is definitely one of those things that the end justifies the means - and the means is a real pain to get through.

I've got all kinds of amazing things to blog about from my Advanced Constitutional Law class - undoubtably one of the best in school, ever - but it's nerdy, and I'm tired, and you probably don't want to read it anyways.

An Open Letter Re: Angry Conservatives

To Whom It May Concern:

Without fail, an issue that is constantly brought up by non-Conservatives when talking about Stephen Harper is that "Stephen Harper has anger management issues, and until he deals with those, he's never going to get elected". I've heard this argument countless times, and dismissed it just as quickly, because it simply isn't true. Serious guy, yes. Angry guy, no.

That said - there is a group of conservatives that need to calm down and take a chill. This group of conservatives are largely responsible for driving the next direction and tone of the party. These people are likely shaping the policy of tomorrow - and so we better hope they get it right.

It's us - the youth, the bloggers, the university students.

There is clearly a place for legitimate anger, and righteous anger. Anger at a Liberal government that has taken millions of taxpayers dollars and funneled them into their own pockets is justified. It's not about policy when it comes right down to that, it's about principle - and, on principle, that is just wrong. It is okay to be angry about that.

The problem, of course, is when we constantly dwell on that anger - letting it fester, and letting it cloud our everyday discourse - and this, not surprisingly, is when you hear people talking about angry conservatives. People are willing to listen to an angry rant about corruption for a while, but if that anger simply continues on towards every single issue, they quickly lose interest (and respect for the ranter).

We need to present a positive approach, and tell people why our view works, rather than simply getting angry and taking shots at the Liberals. We've done more than enough of that - far too much. It's almost gotten to the point where the focus is on the policies we don't like, and why we don't like them. That focus is useless, counter-productive, and ultimately, harmful at the ballot box.

I'm guilty of this as well - so I'm definitely preaching at myself as well. At times, anger is justified - but often, we tend to dwell on this anger, rather than deal with it, and then present a positive outlook. Instead, we get angry, upset and frustrated - which is soon leads to a constant frustration that pervades the rest of our discourse. Before you know it, Stephen Harper is being painted as having "anger management issues" when it's really us that can't seem to get on the positive track.

Consistent harping on the negative will only go so far - then it simply backfires, and soon - we can't find anything positive. We need to find the Canada we want, and tell people about that vision - about integrity, honour and vision.

You catch more flies with honey than vinegar. It's about time we conservatives start following that ancient axiom.

Ottawa needs a win in the worst possible way. They are looking in real trouble after the hot start. Winnipeg also needs a win if they want any chance of making the playoffs. Ottawa will pull out the tight one at home.

The Stampeders can really make the West division race for 2nd place really interesting with a win. After it looked like Hamilton was maybe getting to together, they went out and stunk up the joint badly against Toronto. How do you get shut out in the CFL? It won't happen twice, but still...

If there was a home game BC might lose this year, this would probably be it. But Montreal traditionally does not play well in BC, and I can't see that changing now. BC has just been significantly better than the rest of the league this year.

This is a tough game to call. Edmonton is on paper the better team, but Saskatchewan has been looking good recently. If Saskatchewan can play the full 60 minutes, they should win. At home, that's just barely enough. The Eskimos need a running game.

Jurisprudence

I've been thoroughly enjoying my advanced constitutional law class - so much, in fact, that I'm going to blog about it, and try to force y'all to read it.

Was reading this article today - The Case of the Speluncean Explorers. Basically, it is Lon L. Fuller's (a prominent natural law theorist) best shot at explaining varying jurisprudential viewpoints using a difficult and thought-provoking case. I'll let you read it at your leisure.

In any event, the article presents the classic natural law theory (Judge Foster's argument), classic positivism (Judge Keen) and a few other less popular or common theories (Judge Handy is basically a populist or legal realist).

Based on that article, I would place myself closest to Judge Keen, although there are some glaring holes in his argument. My professor made an interesting comment in class that the easiest way to resolve this issue may be to simply resign - rather than implement a verdict that you think is morally wrong.

This case hilights the many problems between morality and the law - namely, what trumps what, and how do you rationally ask one to trump another. Judge Foster's argument simply doesn't work - too many holes. Judge Keen's argument is logically solid, but it leads to a result that "just seems wrong". Of course, the easy solution is for the legislature to legislate around it - but this doesn't help the spelunkers, and it doesn't say WHY it is wrong.

And that's a real problem with the law. We can say something is wrong, and Judge Keen explicitly states why this is so. Judge Foster, however, is the only one that attempts to explain WHY it "feels wrong" to act in the manner Keen does.

Vox Popped

This post was going to be so much better if the images were properly working.

Everyone's favourite rockstar has apparently changed his mind on Paul Martin.

I love U2. I've never had a problem liking bands regardless of their political affiliation (although guys like this dude are making it tough on me). And, after all, Bono's a good guy. One of the few I think is genuine in his caring for his political issue. Regardless of his approach, I actually think he knows his stuff, and tries hard.

But it was only a few short months ago that he was publicly thrashing Martin over his foreign aid (at the Vancouver concert that kicked off the current tour). Now, apparently, things have been patched up - patched up so far that now Martin is "a great leader for Canada" who can "lead the world out of despair and poverty".

Pretty heady stuff. And pretty flat out ridiculous. A great leader is one who changes his mind on the moral topics of the day depending on which way the polls swing? A great leader is one who refuses to do anything about increasing foreign aid (and Martin's track record makes you wonder exactly what Bono was thinking when he said this. What DID change between April and now?)?

But, I suppose that's just Bono being Bono.

Speaking of - what's with the current in-phrase of "Oh, that's just Manny being Manny"? Apparently, that's the new "excuse-me" phrase. Maybe I'll start passing off all my wacky ideas as "Joel being Joel". Can I get away with that, please?

Oh well. Since those U2 concerts (all 4 of them) sold out in about 3.8 minutes - which, Bono being Bono or not - is the only reason I'm not there, I suppose I'll be left with iTunes. And, if ever I feel the need to hear a good ol' RW group, I'll just have to switch over to these guys or these guys.

Gotta Love Monday Mornings

No, seriously. It was a great morning.

Kicked it off at around 7 am with a discussion with Zach regarding this passage from Genesis. Zach made 2 particularly insightful comments:

1) Jacob was pretty desparate. Note how he says "Give me my wife, I want to lie with her". Pretty one-track mind, if I might say so myself.

2) Jacob was REALLY desparate, because he didn't even bother to check her face to make sure she was the RIGHT sister. Either they were Siamese twins, or Jacob never really looked at their faces all that closely, or something.

Then, the bus. I got on with a group of about 4 other people. One of the people in front of me knocked another bus patron's coffee all over this poor lady. All over her skirt, shoes - the whole nine yards. And what does the offender say to this? "Oh, sorry about that." And she goes on to find her seat. There's rude, and then there is that.

Further bus stories. I've never understood why people get on the bus at Western and Sarnia, and then get off at Alumni Hall. And then those same people comment on how they are planning to go to the gym at Goodlife later on in the day.

Now, I'm not the most "in-shape" guy in the world, but to me, to take the bus for a block and then spend $30+/month on a gym membership seems more than a little stupid. It's one block, people.

Week 1 Rewind

Well, I got 3 hours of sleep on Friday night (actually, it was Saturday morning). As one of my friends put it - "So, your great plan to avoid burn out burned out after less than one week, huh?"

Pretty much.

But, and here's the rub, it was worth it. Very worth it. I met a whole bunch of awesome people in all years, and got to spend a lot of time with all the good friends from 2L and 3L. Well worth the tiredness. You guys rock. Seriously.

I also have a new nickname from Graffiti night. "The Hammer". If the shoe fits...

Pastor Rick gave a sermon from a wrestling ring they set up on the stage at church today. It was really cool. The band sang "Vertigo" by U2, we saw a 3 minute live UFC fight (staged, of course, but it was really good) and the talk was all about the church's relevance in society today. It was really, really good.

I really need to get the CD player fixed in my car.

If anyone out there is wondering about the lack of political content in recent weeks, it's because there's been nothing really going on, and I've been too bored with politics, or too busy with school to post on it. I do smell another CBC post coming up soon. Stay tuned. That said, I do think that the Tory senator saying today that she doesn't think the CBC should cover the election because they are biased is being a bit ridiculous. Although I generally agree with her about the CBC being missed most by the dippers and liberals, I think that saying they shouldn't cover the election is more than a little ridiculous.

I'm really looking forward to law school this year. Year 3 is going to be the best one.

He'd definitely need a job, because fighting crime wouldn't keep him busy enough - and definitely not exciting enough.

What's he going to do - pull over the guy that just ran the red light and almost hit me?

2005 NFL Predictions

Here's my take on how the 2005 NFL Season will break down. Sorry for the sports related post. I am not going through every single NFL game. But I will post these predictions for the year:

AFC EAST
Patriots (12-4)
Jets (11-5)*
Bills (8-8)
Dolphins (2-14)

This is still one of the toughest divisions in the league, regardless of the Dolphins. Pats are still the team to beat. Jets are an injury away from a disaster, and the Bills have an unproven QB and rookie (but they'll be scary in a year or two). The only question for the Dolphins is whether or not they'll get Leinart.

AFC NORTH
Ravens (11-5)
Bengals (9-7)
Steelers (8-8)
Browns (5-11)

Ravens will improve as Boller does. Bengals will take another step - but will it be enough? Steelers will show that last year was a fluke - no Bettis or Staley to start the year. The Browns will be bad, but not completely bad.

AFC SOUTH
Colts (14-2)
Jaguars (10-6)*
Texans (5-11)
Titans (3-13)

2 good teams, 2 awful. Corey Simon is going to help the Colts in a huge way. The Jags are looking like a cool pick. The Texans are just not taking that next step. And the Titans will be bad, very bad. Just not as bad as the Dolphins (I hope).

AFC WEST
Chargers (10-6)
Broncos (10-6)
Chiefs (9-7)
Raiders (5-11)

The Chargers will regress, but not that much. The Broncos are just the Broncos. The Chiefs still will struggle on defence. The Raiders will outscore some people, but no D. This is a tough division, because any of the top 3 teams could have a run.

Wild Card Weekend: Ravens over Jaguars, Jets over Chargers
Semis: Colts over Jets, Ravens over Patriots
AFC Final: Colts over Ravens

NFC EAST
Eagles (12-4)
Cowboys (9-7)

The TO/McNabb problem won't be a problem during the season. The Cowboys will ride Julius Jones. The Giants will improve a bit, but I'm guessing it'll be year 3 where Eli really gets going. Redskins are an awful team.

Packers (6-10)
Bears (5-11)

Vikings are one of 4 NFC teams with a reasonable shot at the SB. Their secondary is now officially awesome - look out. The Lions are going to take a huge jump with Kevin Jones and Harrington's Horses. Packer fans better get ready for some rough years. Bears are going to be awful - Benson will struggle, no Grossman - it could be worse. Bet Muhammed is wishing he was back in Carolina.

NFC SOUTH
Panthers (12-4)
Falcons (11-5)*
Bucs (5-11)
Saints (4-12)

Speaking of the Panthers, they are going to be really, really good this year. Peppers is a freak. Falcons are good, but until Vick learns to be a QB, rather than a RB, the Falcons will never win a SB. Bucs will survive, thanks to Gruden's new Cadillac. The Saints have other things other than football on their mind.

NFC WEST
Cardinals (8-8)
Rams (8-8)
Seahawks (6-10)
49ers (3-13)

I really hope the Cards win it. It'll be a dogfight and all about the 2 games with the Rams. The Rams aren't going back to the SB yet - give Stephen Jackson another year. The Seahawks will blow up the team after this season. The 49ers aren't worth talking about - but they'll win a couple games because they play in this divison.

Wild Card Weekend: Panthers over Lions, Falcons over Cardinals
Semis: Panthers over Eagles, Vikings over Falcons (wow, that's going to be an awesome game)

I knew that first week was going to be fast.

I just didn't realize it would be THIS fast. As in - I can't believe it is only Wednesday, because a tonne of stuff has happened in the past 2 days. Enough stuff, I believe, to fill about 5 days.

Really, it's a "hit the ground running, and never stop running". Those 5 days of vacation last week were really nice.

I have to stop playing so hard. Slid into 2nd base tonight in shorts. Never, ever slide in shorts.

Did you know that rubbing alcohol burns 10x more than hydrogen peroxide? We always feared hydro-perox when we were kids, but we never experienced rubbing alcohol. Wow.

And yes, I'm a wuss. But I'm okay with that now.

I really liked Abe's post the other day on IVF and the rest. Abe and I don't agree on very much (all you have to do is look back through the comments on both of our respective blogs), but this is something I think I agree with him on.

I think my Advanced Constitutional Law class is going to rock. It sounds like we are doing a lot of legal theory reading, which is right up my alley. Philosophy 140 (Philosophy of Law) was/is my favourite course ever at university. Good stuff.

Let The Juggling Begin

To juggle: to keep more than one thing in motion or progress at one time

Really, is there a better word today out there to describe the vast majority of North Americans?

I attended Glad Tidings Assembly this morning - part of the continued search for a home church. I don't generally go into long posts on sermons that I hear, but this one was excellent.

Basically, we need to slow down.

It's always rushing here, rushing there, rushing all over the place, with nary a moment to stop and rest. We feel guilty about taking breaks, and even when we do, we're always thinking of what we need to be doing.

As a general rule, we're all out of balance. We sleep 2.5 hours less per day than our grandparents did. Always running, never breathing.

Isn't it better to burn out rather than rust out? That's all well and good, but at the end of the day, we're still "out". And does it really matter if you're still out?

So there's a goal for the beginning of law school. To maintain balance, and try to keep a semi-even keel. Trying not to burn out.

Ultimate Frisbee

I played ultimate frisbee for the 2nd time in my life yesterday, but the first "official" time (in that the other time was with about 30 people and you could take all kinds of steps and stuff).

Wow.

What a great game.

After hearing a quick rundown of the rules, I was told that we were going to play a "man-defense" style. I understood this - it's exactly the same as playing a man-to-man defense in football. A few time, football instincts got in the way, and I initiated a small amount of contact - which is a no-no in ultimate. Moreover, you call your own fouls - unheard of in football. In football, of course, the whole point of defense is to try to get away with as much contact as possible, without actually making it blatant enough for the ref to notice. Afterall, the whole point of football is "contact".

Needless to say, I got burned a few times, and I committed a couple fouls (old habits die hard). But we did win, and I did manage to improve my throwing technique a bit by the end - in that I was able to throw it reasonably straight. Once I got the defence down, I felt good - defence is way more fun than offence in almost every sport (except hockey).

Again, though, football instincts die hard. Every time I picked off a pass, I almost started running back down the field with it.

But it's a great workout, to be sure.

And it's amazing how big it is. They have an ultimate players association. At Princeton, somebody compiled this list of ultimate websites (and I'm sure that's not the entire list). When you google "ultimate frisbee tournament" you get 95,500 hits.

I'm sure I'm late to the boat here, and I'm sure many of you fellow bloggers have already discovered the joy of this game, but it's really good. Not quite as much fun as american football, because nothing can quite beat the artisticness (is that a word?) of that game, but still.

Ultimate Frisbee is really, really good.

Ottawa is improving, but Montreal's at home. And Ottawa still has allowed more points than they have scored. That's not a recipe for success.

The Roughies have been playing poorly, but the Blue Bombers just lost to Hamilton last week. That's not gonna earn them any points in this man's book.

This is tough one. If Calgary plays their best, they can easily win this. But Edmonton knows they need this game if they want any chance of catching BC for the division title. That'll be enough - barely.
